The agreement governing your use of our site and services.
Welcome to On The Rocks Girls. These Terms of Service ("Terms") govern your access to and use of ontherocksgirls.com (the "Site") and the mobile bartending services provided by On The Rocks Girls ("OTR," "we," "us," or "our").
By accessing the Site, submitting an inquiry, or booking our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1Acceptance of Terms
These Terms form a binding agreement between you and OTR. By using the Site, contacting us, or engaging us for an event, you confirm that you are at least 21 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms and all applicable laws.
2Our Services
OTR is a boutique mobile bartending service operating across Southern California. We provide professional bar staffing, equipment, mixers, garnishes, and event execution for private and corporate events.
Client-supplied alcohol model. OTR does not sell, supply, or provide alcohol. All alcoholic beverages served at your event are purchased and provided by you, the client. We provide the bartenders, bar setup, mixers, garnishes, ice, and service.
Service offerings, package details, and availability are subject to change. Specific deliverables for your event will be defined in the Service Agreement (see Section 4).
3Inquiry & Booking Process
Submitting an inquiry through the Site, by phone, or by email does not constitute a booking. Our process is:
- You submit an inquiry with event details
- We respond within 24 hours with availability and a customized proposal
- We collaborate on details (menu, staffing, timeline, add-ons)
- A booking is confirmed only upon execution of a written Service Agreement and receipt of the required deposit
Pricing, availability, and event details discussed before signing are estimates and subject to confirmation in the final Service Agreement.
4The Service Agreement
Each booked event is governed by a separate written Service Agreement that includes the specific terms, deliverables, schedule, pricing, payment terms, and cancellation policy for that event. These Terms apply in addition to the Service Agreement. In the event of a conflict, the signed Service Agreement controls for that specific event.
5Client Responsibilities
To allow OTR to deliver our services safely and successfully, the client agrees to:
- Provide all alcohol for the event in legally purchased and properly stored condition
- Secure all required permits from the venue, municipality, or other authorities, where applicable
- Provide reasonable site access for setup, service, and breakdown, including parking and load-in
- Provide a suitable bar location with adequate space, lighting, and (where applicable) shelter from weather
- Confirm guest count and event details within the timelines established in the Service Agreement
- Ensure all guests served are of legal drinking age (21+ in California)
- Treat OTR staff with respect and provide a safe working environment
Licensing & Insurance
OTR maintains the licensing and insurance required to operate as a mobile bartending service in our service areas, including general liability and liquor liability coverage where applicable. Certificates of insurance are available upon request and may be required by your venue.
OTR's licensing and insurance do not transfer to or cover the client, the host, the venue, or any guests. The client remains responsible for any permits, host liability considerations, or coverage required for their specific event or venue.
7Payment, Deposits & Cancellation
Payment terms, deposit requirements, and cancellation policies are set out in your Service Agreement. As a general framework:
- A non-refundable deposit of 25% of the total event fee is required to reserve your event date
- The remaining balance is due fourteen (14) days before the event
- Cancellations made thirty (30) days or more before the event forfeit the non-refundable deposit; any amounts paid beyond the deposit are refunded
- Cancellations made less than thirty (30) days before the event forfeit all amounts paid
- Rescheduling requests are accommodated free of charge when availability allows; if a new date cannot be accommodated, standard cancellation terms apply
The specific terms in your signed Service Agreement govern your event.
8Service Conduct & Right to Refuse Service
OTR bartenders are trained to serve responsibly. We reserve the absolute right, in our sole discretion, to:
- Refuse service to any guest who appears intoxicated, underage, or otherwise unfit to be served
- Refuse to serve from alcohol that is improperly labeled, suspected of being illegally obtained, or unsafe
- Pause or end service if guest behavior, venue conditions, or safety concerns warrant
- Remove staff from an event in cases of harassment, threats, or unsafe conditions, without refund
These decisions are not grounds for a refund.
9Limitation of Liability
To the fullest extent permitted by law:
- OTR's total liability arising from or related to any event, the Site, or these Terms is limited to the total amount paid by the client to OTR for the specific event giving rise to the claim
- OTR is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost goodwill, or damages arising from guest conduct
- OTR is not liable for the actions, conduct, intoxication, injuries, or property damage caused by event guests, hosts, venues, or third parties
- OTR makes no warranties, express or implied, beyond those required by law
Indemnification
You agree to indemnify, defend, and hold harmless OTR, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your breach of these Terms or the Service Agreement
- The conduct or actions of your guests, including any injuries, property damage, or claims related to alcohol consumption
- Alcohol you provided being unlawfully obtained, served to minors by you or your guests, or causing harm
- Your failure to obtain required permits, licenses, or insurance
- Your violation of any law or third-party rights
Force Majeure
Neither party will be liable for delay or failure to perform due to causes beyond its reasonable control, including natural disasters, fires, floods, severe weather, public health emergencies, government action, civil unrest, power or utility failures, or other events of force majeure. In such cases, the parties will work together in good faith to reschedule the event or, where rescheduling is not feasible, address the booking in accordance with the Service Agreement.
12Intellectual Property
All content on the Site — including text, photographs, logos, graphics, and design — is owned by OTR or used with permission and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written consent.
Photographs taken by OTR or our authorized photographers at events may be used for portfolio, marketing, and social media purposes unless you opt out in writing in the Service Agreement.
13Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms, the Site, or our services will be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
Before filing any formal action, the parties agree to attempt in good faith to resolve disputes through direct communication.
14Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above reflects the most recent version. Material changes will be posted on the Site. Your continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.
15Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and any signed Service Agreement, constitute the entire agreement between you and OTR regarding the subject matter and supersede prior understandings.
